What PNY Revealed
After 56 days of silence, an attorney CC'd, and federal warranty law cited — PNY supervisor Bruce P. finally responded on March 10, 2026. What he said blew the case wide open:

Build Redux sourced this GPU through unauthorized channels — gray market, diverted inventory, or a distributor that isn't supposed to sell to them. They sold it at full retail price with no disclosure that the manufacturer warranty might not apply.

Federal law (15 U.S.C. §§ 2301-2312). The warranty follows the product, not the sales channel. In 2018, the FTC sent warning letters to ASUS, HTC, Microsoft, Nintendo, and Sony specifically stating that "authorized dealer" warranty restrictions likely violate this law. PNY is doing exactly what the FTC warned against.
Build Redux's Undisclosed Sourcing
Build Redux sold hardware through unauthorized channels at full retail price without disclosing that the manufacturer warranty might not apply. Under North Carolina's Unfair and Deceptive Trade Practices Act (N.C.G.S. § 75-1.1), this may allow treble (3x) damages.
PNY's Double Standard
PNY accepted the Micro Center RMA without "authorized dealer" objections. Same company, same warranty type, completely different treatment.
PNY's RMA Obstacle Course
Even when PNY "accepts" an RMA, the process is designed to exhaust you. Their actual shipping requirements for an $8,299 GPU:
Antistatic bag required
Original mounting bracket must be attached or they reject it
Do NOT include retail box — they won't return it
3 inches of bubble wrap on all sides
Place inside a sturdy inner box
Inner box inside a larger outer box with 3-4 more inches of padding
Any damage on arrival "not previously reported" voids the claim
Customer pays ALL shipping
PNY not liable for items lost in transit
"This RMA does not guarantee a replacement"
May receive a refurbished unit or "different but equivalent model"
30-day turnaround — don't ask before then
